these sections add to the studio terms of service at anchorpoint.studio/terms, which still applies. they cover the software store and the aps apps.
these terms cover buying aps apps and the aps suite on store.anchorpoint.studio. the seller is Anchor Point Studio LLC, a Wyoming limited liability company, c/o Registered Agents Inc., 30 N Gould Street Suite R, Sheridan, WY 82801, USA. by buying you agree to these terms, to the end user license agreement shown at checkout and in the installer, and to the refund policy.
the apps are licensed, not sold. a purchase gives you a license key and the right to use the app as the end user license agreement says. in short: buy an app once and you may use it on 3 machines at a time, forever, with every update to the major version you bought. subscribe to the aps suite and you may use every suite app, now and later, on 10 machines at a time, for as long as you pay. the full terms, including what counts as a machine, online checks and the sunset promise, are in the eula.
prices are in us dollars. the price you see at checkout is the price you pay, plus any tax we must add for your country or state (see "taxes"). we can change prices at any time; a change never affects a purchase you already made, and a subscription price change comes with notice (see "the suite").
one payment, one key, emailed to you and shown on your account page. your key covers every 1.x release we publish for that app. if we release a 2.0, it is a new purchase at a discount for owners, shown on your account page; your 1.x keeps working.
square processes our payments; we, not square, are the seller of record and we are responsible for the taxes on each sale. prices are shown before tax. where we are required to collect sales tax or vat, it is added at checkout and shown before you pay, based on the billing country (and state) you give us. you agree to give us your correct country. for business buyers in a vat country we may ask for a vat number.
at launch, checkout is not available to buyers in the european union or the united kingdom. if you are there, email [email protected] and we will tell you when it opens or arrange a purchase by hand.
14 days, no questions, for any purchase, including the first payment of a subscription and any renewal charge. ask on your account page or by email. the full policy is at store.anchorpoint.studio/refunds. when a purchase is refunded, its key stops working at the next check and the machines on it are signed out.
if you dispute a charge with your card issuer, the key is turned off as soon as square tells us, and it stays off unless the dispute is decided in our favor. please ask us for a refund first; it is faster and we say yes within 14 days.
one account per email address. the sign-in code we email you is for you alone. keep your email address current on the account page; it is how we send keys, receipts, renewal notices and anything the law requires us to tell you. you can change it there; we verify the old and the new address.
the machine limits (3 per bought app, 10 for the suite, one machine counts once across suite apps) are counted by our server. you manage your machines on the account page. our server also applies rate limits to protect the service; a key activated on an unusual number of machines in a short time is flagged and may be paused while we check with you by email.
the apps are provided as they are. we test them on the hardware and software the product pages name and we tell you what we have not tested. we are not liable for lost footage, lost data, lost work or a client's claim, and our liability is capped at what you paid us for the app (or in the last 12 months, for the suite). none of this takes away rights a consumer law gives you that cannot be waived. the 14-day refund is in addition to those rights.
you have a 14-day right of withdrawal for digital content. at checkout you tick a box asking us to deliver at once and acknowledging that you lose that right when delivery starts; we record it on your order. our 14-day refund applies anyway, so you are not worse off. (checkout for the eu and uk is not open at launch; see "taxes".)
the eula promises that if we ever shut the license server down for good, every owner receives a final build of each owned app without the license check, suite subscribers whose subscription is active at that time receive the same final build of every suite app at no extra charge, and we keep the signing keys in offline escrow so that build can be made. that promise is part of these terms.
the apps contain third-party components under their own licenses; each app's notices page at store.anchorpoint.studio/notices lists them, including the open-source rights the eula does not restrict. aps player's camera raw support, where offered, depends on components licensed from their maker; the product page says whether a build includes them.
we date these terms. a change applies to purchases made after it. for a running subscription, we email you about a change that affects you at least 30 days before it applies; you can cancel before then.
these terms are governed by the laws of the State of Wyoming, USA. consumers keep the protection of the mandatory law where they live. write to [email protected] first; most things are sorted out in a few messages.
